It is your obligation as an employer or duty holder of a commercial or residential building to provide a safe environment for employees, residents or visitors.
A fundamental part of building safety management is Passive Fire Protection measures. The Regulatory Reform (Fire Safety) Order 2005 sets out clear accountability and responsibilities for the Responsible Person to adhere to. Failure to manage buildings could mean that you are responsible for, in accordance with this legislation, may lead to temporary closure and enforcement action being taken by the local Fire and Rescue Service or the HSE. Enforcement action can lead to criminal convictions for more serious offences.
At the heart of building safety management is the fire safety strategy, design and the passive fire measures implemented. As a Responsible Person, you have a duty to ensure the Passive Fire Measures have been installed in accordance with the fire strategy for the building, the design, specification and relevant approved documents. One of our passive Fire Inspectors can offer advice on whether the dwelling is of a high standard to ensure the safety of all.
You are required to control contractors working within your buildings to ensure ongoing maintenance work does not breach the Passive Fire systems installed and where it does, the measures you must take to ensure that the Passive Fire systems are restored and certified.
It is important to appreciate you have an obligation to ensure the building is operational in accordance with the design and specification and that it is maintained in accordance with those same principles, or any defined within a design or specification change.
